Headlines pre-condition the reader before having read the article. And editorial staff of American Military News certainly know that full-well. This is not click-baiting, it is something else.

Procedures for export of technology from China

Regulations of the People's Republic of China on the Administration of Technology Import and Export

We looked a little bit into what the actual procedures should be.

Categories of technology export from China

There are three categories of technology exports:

  • Free - is subject to post-contract registration and filing (!)

  • Restricted - import and export requires application for a license

  • Prohibited is just that, prohibited (most of the time, that is)

Category “restricted”

The “restricted” technology export procedure in 5 steps:

  1. Application for technology export permit at the provincial department of commerce for joint review with the provincial department of science and technology. Approval or rejection within 30 working days from the date of receipt of the application;

  2. If approved, issuance of the "People's Republic of China Technology Export Licensing Letter of Intent" by the provincial department of commerce;

  3. Only after receipt of the “People's Republic of China Technology Export Licensing Letter of Intent” the applicant may hold substantive negotiations with the outside world and sign a technology export contract;

  4. After signing the technology export contract with the foreign party, the applicant must apply for the "People's Republic of China Technology Export License". The provincial department of commerce must decide whether to permit or reject the technology export within 15 working days from application.

  5. In case of approval the provincial department of commerce will issue the "People's Republic of China Technology Export License certificate"

The technology export contract becomes effective only after the “People's Republic of China Technology Export License Certificate” has been issued.

Relevance to rare earths

This process would apply to items like “ion type rare earth mine leaching process”, item 210901X on the “Restricted for Export” list of the proposed “China Export Prohibited / Export Restricted Technology Catalogue”. (See Southern Alliance Mining below).

Compliance

Somehow we can’t help wondering if the aforementioned procedure was followed in case of Myanmar.
